Those that kill should be met with the same treatment.
That way you'll create an endless loophole, just because the man that pulls the switch of the chair is wearing a police uniform doesn't mean it isn't murder, if your statement is correct (which it isn't) then the man (or woman) that pulled the switch should get the chair too, and so on...
