So what? It's reskinned... plus if it will have other functions, it won't be stealing.
Stealing is when you copy everything exactly as it was... along with the skin. ;-] Assuming the model itself is free to be used.
And this one appears so.
EALA released Art pack for CnC3, The Vert is in there. Look it up.

The Vertigo there looks actually very nice with new colors :D
