The RPG is theirs. An engine is an engine. People make games with Ogre3D all the time, and this is a step on top of that.
As for any IP complications with Morrowind, an entirely new game file can be created that doesn't use any part of Morrowind at all. :)
Many mods are already playable in the current versions of OpenMW. :) Any pure CS built mod should be 100% portable if not now then by the 1.0 release.
I have had the pleasure of testing a very early alpha for this game a few months ago, and I have to say that the tech is quite sweet.
Overall the game is a very unique experience and I am very curious about seeing it come to life with the beta and release.
