What exactly does Warner own? Could you, for exemple, realize a mod set in the second age? Correct me if I'm wrong, but is it not the Tolkien Estates who own the rights of the Silmarillion? Would they be more likely to sue you than Warner if you decided to realize a mod in this setting? Maybe this is a solution, or a compromise, if this could not go through. But it would require to make Beleriand, wich would be a ton more of work. Or as a plan B you could make a mod about Númenor. Maybe less ambitious but it would be quite awesome! Just trying to toss out ideas... but I'm sure you already have discussed about this privately ;)

I agree. WB cannot see what is on your computer. You can do anything you want privately. Just don't release any updates for a while.

The cease and desist seems to concern only on the content you have posted on your page. This doesn’t restrict you from continuing the mod at all. I suggest you to close your Moddb page and secretly continue your mod until you finish the first release. You could release the mod in Torrent format, sent by E-mail . For updates, publicity and recruitment, continue to post in your thread in the Bethesda official forum, but refrain from posting pictures :)
