You can kiss this goodbye then. Not to say that it's absolutely hopeless, but unless waiting several years until they forget about it is the plan, the odds of them saying "no, never mind, go ahead and infringe copywrite\" are essentially 0.

Can we please just ignore the pointless C&D? They can't stop you from modding. Lets just deal with it at the publishing phase. I sincerely hoping the project is continuing in secret.
Mod in secret, using private means of discussion, only allowing trusted members in. If the legal issues still have not been sorted out by the time it's ready, just release it anyway.

I think it would be amazing to make the evil races playable as well. For one, orcs are not all 100% forced to do Sauron's will (example: Sauroman's uruks). Nor are they a sort of hive mind (evidenced by orcs disagreeing constantly with this matter or that in the books), so I feel that the evil races DO have some sort of willpower of their own. Not saying it should be a priority, but it would be so cool to have playable evil races :D
