Godspeed man, would suck that a decade long mod gets destroyed over arbitrary ******-up-ed-ness, i would say independently publish the mod.
Then again don't listen to me, i just hate it when ppl claim originality on something because they're making money off of it. How many indie game ppl of moddb never get ever heard of and they're all quite original, but because one **** struck it rich, he uses the "i got mine, you can't have yours" mentality to justify his schtuff.
Doing some more searching, look into Fair Use Laws,Mods appear to fall under it, The MERP guys may have been doing soemthing on the side as to why they were stopped two by the same reasons.
