Not a legal expert or anything, but what does the US governments recent position on the EFF/Goodwin case mean for you?
The case seems to set a precedent; just because you've worked with the LOTR lore, and are creating a mod for Skyrim, isn't enough for WB to assert any right over it. If files aren't property, there is nothing for them to exercise control over.
Just a thought.
