It says Fantasy Flight Games right there, a visit to the artist's page also reveals a sororita, so yes, this is 40k, and likely a generic corrupt guardsman.
and you assume 40k is all Fantasy Flight Games do? and that 40k is the only thing the artist does? you're not only bold, but foolish too.

here's the full FFG product catalog. read and learn. if you knew the most basic things about 40k and the Imperial Guard you'd have seen instantly that this is not Warhammer. how? the eagle has one head. the Imperium's official symbol has two, and deviating from that is heresy. and a possessed traitor guardsman would wear a proper emblem of Chaos, not some half-assed Aquila replica. they probably don't even know of one-headed eagles.
Well, guess you're right, I backtraced the image and turns out it's cover art for a book for Tannhauser.
I do not question my knowledge on 40k though, I accept variety that can occur within it, as well as the possibilities of artists' imaginations and I definitely appreciate it. I am no fan of the stagnation of everything 40k.
