Post news Report RSS CBS Sues Axanar (Film) and the Future of this mod

Hello Folks, As you may have recently read Paramount and CBS have filed a law suit against Axanar Studios and this has caused some concern in our Mod DB Community. Below is a summary of what will happens from here on in...

Posted by on

Due to this team being made up of volunteers and the prospect of our own work being targeted in the future we have come to a group decision that we can no longer continue work on this particular titled mod.

However our Art Assets concepts and ideas will make an appearance in our new piece of Armada 3 called The Lost Years which was under existing development.

We are saddened to have to abandon our work on this mod and we hope that you can understand why and continue to support us with Armada 3 and The Lost Years Universe, Where we will adapt our gameplay tactics into this new endeavour.

To all our fans thank you for supporting us and Live Long and Prosper!

Armada Series Dev Team

Hmm pretty shocking. All this Axanar is doing is showing fandom and appreciation for the Star Trek franchise. Even from a greedy, evil corporation point of view it is an asset. I just don't understand.

It's punching the fans in the stomach. Nothing more.

Yes indeed, but as we're seeing increasingly often from film/TV studios and game publishers their view of fans these days is, "**** you, give me money!".

I just read some articles about it and don´t really get what this law suit is about. It´s something about copy right but other fan films "violated" those copy rights, too with no obvious consequences. Some even seem to have made money with their films while Axanar won´t.

I now hope that this film won´t be cancelled. To bad that you stopped this mod but continuing your work seems a bit risky right now. Maybe you can go back to it at some point later.

Can't you guys just put this project on hold till the lawsuit is settled? There is a large support campaigns going on, we may yet change CBS's mind:

Rather than putting one project on indefinite hold, we'd rather focus on producing something that we can enjoy making and that we can all enjoy playing. Many of the ideas and features we had planned for Axanar will now feature in The Lost Years.

That, and the risk is just too high. This project carries the same name as the Axanar film and the producers of the film have publicly expressed support for the mod. The connections are there. In the end, it's just not worth it.

Yeah, it would be aweful if the greedy lawyers end up going after STA3 because of that.

I'll make sure to never buy anything officially labelled Star Trek anymore. What a shame.

The MOD would likely be indirectly hit by a C&D order to moddb which has happened in the past.

That is a good point. They would likely see Axenar(the movie) and Axenar(the mod) as one and the same, or at least related, from a corporate standpoint. And I would really hate for STA3 to be taken down because it merely got their attention.

But really CBS? Was Battlestar Galactica not enough? Now they are going after Star Trek fan-projects?

I completely understand where you and the team are coming from. I still hope though that if the suit goes in Axanar's favour, you would consider reviving this mod as its own thing.

Also, if CBS decided to go after you at some future point (perhaps for Armada III), I think there's a good chance the mod would be considered a trans-formative work worthy of fair use protections. It certainly should be in my view, and their should be protections for people who make no profit from their work.

Will "The Lost Years" be part of the Armada 3 page, or have it's own?

While we'd be pleased as punch if the Axanar film project could be allowed to continue, we honestly don't see it happening. The chances of this lawsuit going in Axanar's favour are slim.

We also doubt CBS would seriously come after us. We'd likely simply be hit with a Cease and Desist. Frankly it's easier just to distance ourselves from the whole thing and work on other projects. At least it's on our own terms.

As for The Lost Years getting its own page, that hasn't been discussed yet - we're still on our Christmas/New Years break! It'd like to see it happen, though. It'd be a shame to waste this page.

Alec Peters seems pretty confident. It looks like he'll try for a settlement, but if that fails, he's in contact with an IP law firm interested in taking the case.

Yeah fair enough about being on break still haha! You guys are doing great work, and I wish I had the skills to offer my help. I'll keep an eye n this page and the STA3 to find out what you decide on doing.

Shame to hear that... There aren't that many TOS Style Mods (that aren't simply reskins) and I was really looking forward to this (as much as I love A3).

I don't think that this would affect the mod.

(NOTE: I'm not defending them, I'm just saying what might have gone through their retarded heads when they sued the fan film.)

They probably sued the film because they see it as a threat to their current film franchise. So, since they are not making a Star Trek space strategy game (as far as we know), I don't think they would have a problem with this.

Of course, the risk still exists (especially since the producers expressed their support for the mod, and corporate ******** are major ********), and doing all this work just to see everything go to waste would be a huge kick in the balls.

On one side, you will not be able to finish this mod, on the other, you will keep working on it to maybe see all (or most) that work go to waste.

This ****** me off (and I'm not even a huge Star Trek fan like you guys).

It's nice to see support from non-Trekkies. You aren't the only one I've seen either. Thank you.

I'd have preferred if they had just left things alone but to be fair, it's not like CBS don't have a legitimate case.

I don't think this is because they're trying to protect their reboot films. Let's face it - Axanar raised a LOT of money for a non-profit project. They were accepting donations right up to the end and weren't entirely transparent with what they did with that money, either.

I'll admit that I didn't keep a close eye on the production of the Axanar film and was content to quietly wait for it to be released. Reading up on it now though, I can see why CBS has a problem.

(buried)

the sheer stupidity of American-style of "Doing business" sucks to high heaven and every ******* one of those corporate slugs should be executed!

But beyond that, i kinda knew that this would happen seeing as the nut jobs holding everything "Star Trek" seem to ALWAYS FORGET that it's the ******* FANS who buy them bigger houses and car and ***** to ****!!!

THOSE ******* will get theirs soon. I think the USA is really gonna have a PURGE :))) and the first to go are gonna be the corp *******.

If those idiots actually were capitalist, then they would have let this go through and they would be happy someone else is footing the bill, so to speak, for a movie!

BUT they obviously are just small minded greedy ******* who WILL BE DEAD, before their natural time-frame. That is for certain :)

It just goes to show you how damn INTELLIGENT Gene R actually was to see all the Now-a-days "Small time corruption" back in the 50's and 60's. lol

I guess i'll be getting a refund on all my axanar monies then :(((

AND more specifically, I WONT be watching the rest of the star trek movies in any ******* theatre ever again.

We're all disappointed mate, but this comment is way too over the top for even my fairly laid back tastes.

Calm down. Let's keep it clean.

A sad time indeed, they aren't giving fans what they want and now they are flat out stopping fans from trying to keep the universe going.

At least you can reuse those assets, would of been a real shame if you had to scrap them.

I would hope you guys will just shelve whatever build you're up to at this point rather than toss it in the trash. There is always the possibility this will blow over due to it hopefully being an over-pushy person from the CBS legal department.

And I'm confused by the reusing of assets...if it's ships and such then there's a very large time gap between Axanar and the Cardassian border conflicts. A part of me hopes that would mean a TMP era addition to bridge the gap but I sadly doubt that would be the case.

Although if you guys ever did a TMP era Sins mod I would love you all till the end of time. Been playing alot of KA2 for Armada 2 and I keep hoping that one days someone will bring that to Sins.
