I think commercial exploitation is the key word there. They probably issued that statement for legal reasons, asserting their authority over the IP.

If one has power, it's best to only use it when one must. Technically, all those sites with lessons on how to learn Sindarin or Quenya violate some sort of copyright law, or so I believe (they all have legal disclaimers). Yet the Estate has allowed those to continue and I haven't heard of any fan-fiction being taken down for legal reasons.

I don't know how they'd react to Merp. Personally, and this is just me, if the Estate wins - when they win - I'd ask them for permission to continue. Appeal to them, make a case and emphasize the non-profit fan part of the project. This mod has too many followers to remain hidden from them for long and trying to hide from them might just make them mad. Of course this isn't up to me, whatever you guys decide to do: God Speed.

I wouldn't mind an easter egg, like finding a large bow near his corpse. But I wouldn't want Lurtz, or any of Jackson's other additions inserted into the mod.
That's what makes Merp special (aside from the enormous map and high quality): It's fidelity to the books.

If the guy in that article I posted is correct and this lawsuit is purely a legacy issue, meaning it doesn't settle out of court, I could see it being over relatively soon (for how long these things typically take). Warner Brothers IS in a weak legal position and would likely try to settle out of court to avoid setting a legal precedent. Though like I said if this is a legacy issue and the Estate really just doesn't like what Warner Brothers is doing, it won't matter how much money Warner tries to throw at them. The Estate won't settle and Warner Brothers will lose the case rather quickly.
IF this is a legacy issue.
