I just uploaded my youtube video about Merp.
It briefly talks about some Tolkien, then jumps right into Merp. For headphone users, the video might be a little loud (not entirely sure though), so a fair word of warning.

A movement is a great idea. We should all try to make our own videos on youtube to raise awareness. While each individual one might not get that many views, collectively it could make an impact.

Great video and use of music; that's the spirit.
Would you mind if I used your video in a few threads I have going about Merp? It'd be nice to show some of these guys a perspective other than my own to help spread the word. I would credit you of course :)

I haven't found any updates myself yet. Last I heard the Estate is trying to get Warner's countersuit thrown out.
Try googling Tolkien Estate vs Warner Brothers (or Zaentz) every couple days.

I've mostly just been keeping the thread up to date on whatever info I can find about the ongoing lawsuits.

EA made BFME 1 & 2 and was planning on making White Council but scrapped it for Conquest.
WB has made Aragorn's quest, War in the North, Lego Lotr and currently owns LOTRO.

The Tolkien Estate moved to have a judge dismiss Warner's countersuit as of Thursday.
Whether it works or not I'm sure we'll find out in the coming days.

This is the same story I posted earlier, but it's from the Hollywood Reporter and they're a little more descriptive by including a side by side of Warner's amended claim.

"On Thursday the Estate asked a judge to dismiss Warner's move, saying the studio is attempting to dress up an inappropriate claim for malicious prosecution."

"She says that Warners' "patently absurd" breach of contract claim is "is really nothing more than a thinly-veiled, deficient claim for malicious prosecution," which can be brought if Tolkien has made a "bad faith" lawsuit against Warners, but not at this early stage."

I think it was the landscape that was 90% generated. They hadn't made any quests or npc's yet or done any voice work, I don't think.

If the Estate sent their own C&D, it wouldn't feel as slimy as when WB did it; no doubt it would still be horrible though.
I think after this business with the lawsuit is settled, Merp should try and go off the grid. Though how, I know not.

That's the question everyone wants to know the answer to, it seems.
I'm betting on the Tolkien Estate winning; they're very cautious and seemed to have been carefully planning this stroke. WB on the other hand is playing defense. They've made a hasty decision with their counter suit. Who was it that said, the hasty stroke oft goes astray? ;)

Good that the Estate is sticking to their guns and that it seems WB main argument is " boo hoo we didn't make as much money as we could have."

Recoveryanonymous Mar 25 2013, 2:39pm replied:

It seems in addition to the Estate's response, WB jumped on the lawsuit along side Zaentz.
""Because of the repudiation,” the studio's filing said per the Reporter, “Warner has not entered into license agreements for online games and casino slot machines in connection with 'The Hobbit'—a form of customary exploitation it previously had utilized in connection with the 'Lord of the Rings' trilogy—which has harmed Warner both in the form of lost license revenue and also in decreased exposure for the 'Hobbit' films." - from the article.

I find their argument hard to take especially after the Hobbit grossed past the billion mark not long ago.

Mini update with the case between Zaentz and the Estate. I originally posted it a few days ago.
Bizjournals.com
"Bonnie Eskenazi, the attorney for the Tolkien estate, called Warners' counterclaim “nothing more than an effort to sue the Tolkiens and HarperCollins for suing them. They are entirely without merit and are a classic example of studio ‘bullying tactics.’ The Tolkiens and HarperCollins filed this lawsuit in order to force WB and Zaentz to live within the boundaries of the contract to which they agreed. WB’s and Zaentz’s amended counterclaims are simply an attempt to punish the Tolkiens and HarperCollins for having the nerve to stand up to the studios and tell them that they can’t take more rights than were granted to them by contract. Luckily, the law protects people like the Tolkiens and HarperCollins from these kinds of intimidation tactics."
