No, is not, search around a little and see how well it went when they tried to do this to a novel published in Amazon called Spots the Space Marine. They got their ***** owned back to them. Neither they possees a lot of those terms as Eldar and such.
They do own the trademark when it comes to their own lore, that means I can't go around selling a Space Marine novel about their space marines explicitly saying is theirs Space Marines on the Warhammer universe. I however can use the term Space Marines as I want to as long I'm not claiming they are Games Workshop Space Marines.
Here my good men: Moddb.com
And I quote Mr. Zahaqiel:
"What GrOrc is asking for isn't to combine the Tyranid Mod in his mod - we said yes to that, like we do for most other modders. And he'd be able to use our models and animations freely (and make his mod a smaller download) if he did that, but he doesn't want to do it that way because it would mean some extra coding on his part."
So it's like, he's not employing the assets which would be fine, he's simply stuffing the whole mod into his.
Mr. Gorb, do you know anything about Heretic? I sent him a sample of a button for the BFG mod and he haven't replied, I hope is not like the button was so disgusting he decided to ignore me :D
And again, after further reading, I see the Tyranid Mod actually gave him permission to integrate their mod with his, explicitly the models and animations, but what about the code? Does that come with the DB entires too? It's still kind of foggy, but from a impartial point of view, of someone that just got here it's starting to look awfully against GrOrc.
I didn't meant to be childish but realistic, as something that can happen, has happened and will sure happen in the future.
Well I actually made a search around for this, in my country you will not be hindered by any kind of law to do what GrOrc has done, however I does seem there's a legal ground to reclaim the use of one assets on international laws even if they themselves are upon a third entity IP. However it's really difficult to see anyone actually pursuing this in a court and probably will be dismissed pretty fast. Also, I don't know about you, but once some moder sues other moder over a mod, modding would die pretty quickly or become a rather unpleasant hobby.
I can relate to both parties here, my advice would be to GrOrc to issue an apologize for not crediting the makers (not owners) of the models and the makers giving permission of use as is a really pity stance to not do so, really, I understand you have your reasons but there's no real monetary or otherwise reason for you not allowing some models to be used for another mod as long you are properly credited, the portfolio argument is specially pity if you asked me. But in the end of the day is your call, and if you simply say no, by the reasons you might have, as a gentleman in a gentleman agreement, GrOrc should accept that and make or find other Tyranid models if he wish to pursuit integrating them into the mod he's making.
And I seriously doubt you can claim legal ownership of a 3d model you make out of other person IP in this case GW, that could actually work against you in most legal systems. Barring that, using 3d assets with disregard of courtesy and asking or even getting to a arrangement is really rude.
As pointed above you can legally use whatever the hell assets you want from whatever mod you want as long is circulating around, there's nothing legally you can do about it unless you actually are a lawyer from GW. And even if so, I seriously doubt any moder would fight legally (paying money to a layer and all that) for another moder using his assets, that he released freely on the internet on the first place, and even if you include a "do not use without permission", well, sorry to burst the bubble but it doesn't have any legal grounds or legs to stand on.
I have made a lot of modding and programing, and never had the slight problem with sharing something I know I can't make money out of it, it's a real pity position to do that.
This is my exact toughs expressed without the restrain of the language barrier.
That guest was me, darn site login expiring.
People should embrace that while doing modding their models DO NOT belong to them, period. Anyone doing modding should be free to use them in their mods. However being educated and asking for, and not doing it if you receive a negative should be the way to go. However the thing is Why to negate such use? As long you are thoroughly credited.
You can't make money or fame with the model, nor do you own it properly. It's sad and pity, really.
The mod creator just did it.
Hey dude, are you alive??
And Space Marine is NOT a "trade mark of GW"
HI! Are you still alive???? Would you please send me the work in progress you had before this went down? I want too finish this.
If not, would you consider working with Nagentus ( Moddb.com ) and his Fire in the Sky mod ( Moddb.com )?
Not that I was calling you an *******. Just to clarify. I understood the motives of why you took the downloads. In the second paragraph I pretty much summed up and in your reply I see I was right.
The thing is that if you are willing not to let go the whole mod, but to allow people to work with in under your strict supervision while you can't directly work with it, we might be onto something huge with this mod of yours.
Much appreciated you uploading the link of the mod. In fact I downloaded only a few days before you took it out from this page Strategyinformer.com but I know many other people here will be more than happy to be able to play it again.
Because he felt like it? Like Westley Snipes said on Demolition Man, "You can't take away people rights to be ********".
Basically anyone with the mod files could work with them, modify some pretty few things here and there on the model ships and said it came up with all of it "based" on this mod. I mean, I could in theory make a double of every model starting from 0.
Wow you are really stupid. Or better said, what an stupid commentary.
I always thought HW lacked that element of ground battles to become the perfect game. Now if they latter somehow joint this two separate games into a single one with a x4 campaign we'll end up having the perfect game.
This is dead right?
Eagerly waiting for this great, great mod!
My thoughts exactly.
Oh... and what about that devilish handsome Horus? He was the leader of the late FoK when I joined the official forums, (basically when they started to die).
It could be perspective, but I love how some look bigger than others.
Oh my! This is something I have expected even moar than the emprah return!
Well it's not my call (in case you are asking me, since you are replying to my post).
I don't get it, you want them to have the burst cannon on their right arms?
Yes, work in progress.
Don't want to be rude or anything but here's a little something of the new version. However I'm not sure if Onard is working with you guys or not:
Here's a short video I just made of a skirmish against the computer with the new internal version. I tried to make some commentaries while playing, but between music being too high and my crappy microphone, you can't really understand what I'm saying. Next videos should go better on that department. Enjoy!

Which forums my anonymous friend? Could you please put a link?
For the emperors golden trousers! Is is true?!! In His Faith we always have hope!
But wait, wasn't hope the first step on the road to disappointment? =oP
That's wonderfull baz.. Bloodtitan, I remember playing with you over your channel on hamachi. The official forums are the ones that seems dead. Even Horus and our grumpy moderator Gorb have left them at the Emperors mercy.
Baz, I'm still a lot interested on helping with development in any way I can.
He traveled in time and.. space to become the director of shield, his hands where replaced but his eye was lost forever.
Over there! Look, behind you!
The link is a few posts down here pal.
